Terms of Service for AnyConversation

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the AnyConversation website (the "Service") operated by AnyConversation ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Age Restriction

You must be at least 18 years of age to use this Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years old. This Service is not intended for individuals under the age of 18. If we learn or have reason to suspect that a user is under 18 years of age, we reserve the right to terminate their account and access to the Service immediately.

2. Description of Service

AnyConversation provides an interactive platform enabling users to engage in role-playing conversations with an Artificial Intelligence (AI) based on user-defined scenarios and personas. The Service may offer various access tiers, including anonymous use with limitations, free registered use with monthly message limits, and premium subscription plans.

3. User Accounts

To access certain features of the Service, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Promptly notify us if you discover or otherwise suspect any security breaches related to the Service or your account.

You are responsible for all activities that occur under your account.

4. User Conduct and Responsibilities

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. You are solely responsible for your conduct while using the Service, any content you provide (User Input), and your compliance with all applicable local, state, national, and international laws, rules, and regulations.

Prohibited behavior includes, but is not limited to:

  • Using the Service for any illegal activity or to promote illegal activities.
  • Transmitting or inputting any material that is (or that promotes activities that are) defamatory, knowingly false, abusive, harassing, threatening, or invasive of a person's privacy.
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity.

We reserve the right to terminate or suspend your account for conduct that breaches these Terms, or for any other activity which we deem to be harmful to the Service, its users, or our business interests, without prior notice or liability.

Responsibility for AI-Generated Content

The Service utilizes a third-party generative AI to produce responses based on your inputs. While we may implement filters or guidelines, AnyConversation has no direct control over the specific content generated by the AI.

You acknowledge and agree that AnyConversation is not responsible or liable for the content generated by the AI, its accuracy, appropriateness, legality, or any consequences arising from your use of or reliance on such content. You are solely responsible for the inputs you provide to the AI and for evaluating and using the AI-generated content at your own risk. We make no warranties regarding the AI-generated content. You are also responsible for ensuring that your use of AI-generated content complies with all applicable laws and does not infringe upon any third-party rights.

5. Subscriptions and Payments

Certain features of the Service may require a paid subscription ("Subscription"). By subscribing, you agree to pay the fees specified for your chosen plan.

  • Billing: Subscriptions are typically billed on a recurring basis (e.g., monthly). Your Subscription will automatically renew at the end of each billing cycle unless canceled by you or us.
  • Payment Processing: Payments are processed by our third-party payment processor, Stripe. We do not store your full payment card details. By providing payment information, you authorize Stripe to charge all Subscription fees.
  • Cancellations: You may cancel your Subscription at any time. Cancellation will be effective at the end of the current billing cycle. (Details for cancellation would typically be found in your account settings or via customer support).
  • Price Changes: We reserve the right to change Subscription fees. We will provide you with reasonable prior notice of any price changes.

6. Intellectual Property

The Service and its original content (excluding user-provided input and AI-generated responses to such input), features, and functionality are and will remain the exclusive property of AnyConversation and its licensors. This includes the AnyConversation name, logo, and all related names, logos, product and service names, designs, and slogans.

You retain ownership of the original content you submit as input to the Service ("User Input"). By submitting User Input, you grant AnyConversation a worldwide, non-exclusive, royalty-free license to use, reproduce, modify (for technical purposes, e.g., making sure content is viewable on different devices), and transmit such User Input solely to the extent necessary to provide and operate the Service, including transmitting it to the third-party AI service for response generation.

Regarding content generated by the AI in response to your User Input ("AI Output"): The ownership and usage rights of AI Output can be complex and may be subject to the terms of the underlying third-party AI provider. AnyConversation does not claim ownership over the AI Output generated specifically for you. You are responsible for ensuring your use of any AI Output complies with applicable laws and the terms of any relevant third-party AI service.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

ANYCONVERSATION DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANYCONVERSATION, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF ANYCONVERSATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE (INCLUDING AI-GENERATED CONTENT); (III) ANY CONTENT OBTAINED FROM THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL ANYCONVERSATION'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (\$100.00) OR THE AMOUNTS PAID BY YOU TO ANYCONVERSATION FOR THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless AnyConversation, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service, including, but not limited to, your User Input, any use of the Service's content (including AI-generated content), services, and products other than as expressly authorized in these Terms of Service.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may discontinue using the Service or contact us at support@anyconversation.com to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Dispute Resolution

These Terms and your use of the Service will be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You agree that any legal action or proceeding between AnyConversation and you for any purpose concerning these Terms or your use of the Service shall be brought in a court of competent jurisdiction as determined by applicable law in the event of a dispute.

AnyConversation makes no representation that materials on the Service are appropriate or available for use in locations outside the jurisdiction in which it operates. Those who choose to access this Service from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

AnyConversation
